Poland Begins Recognizing Same-Sex Marriages Registered Abroad

On August 23, 2026, new rules took effect in Poland allowing civil registry offices to officially transcribe same-sex marriage certificates concluded abroad. This marks the first systemic recognition of such unions in a country where domestic same-sex marriages remain illegal.

The changes were adopted by the government following rulings by the Court of Justice of the European Union and Poland’s Supreme Administrative Court. According to a report by The Washington Blade , the new civil status forms now include three options: “woman and man,” “woman and woman,” and “man and man.”

The implementation of the new rules faced resistance from Poland’s Constitutional Tribunal. In late July, the court ruled that registering foreign same-sex unions violates the country’s constitution, which defines marriage as a union between a man and a woman. However, the current government refused to comply with this decision, citing the illegitimacy of the tribunal’s current composition. Minister of Digital Affairs Krzysztof Gawkowski emphasized that the transcription of documents remains legal, and over a dozen couples received their new certificates in the very first days.
