Colorado Parents Challenge Inclusion of Transgender Athlete on High School Volleyball Team

In October 2026, four families of student-athletes at Dakota Ridge High School in Jefferson County, Colorado, filed a formal complaint with Jeffco Public Schools administrators, protesting the exclusion of eight female students from the junior varsity volleyball team after a transgender athlete was selected for the roster.
According to Breitbart News, citing an initial investigation by Fox News Digital, the parents filed a Title IX grievance alleging sex discrimination and demanded an independent review of tryout evaluation rubrics, eligibility records, and communications within the coaching staff. Parents reported that more than 35 girls participated in tryouts, with eight cut from the final roster, including seven high school juniors.
One mother, speaking on condition of anonymity, told reporters that her daughter had played for the school team during her freshman and sophomore years and hoped to pursue college athletics. Ahead of tryouts, coaches asked the student, who had trained extensively as a setter, to transition to right-side hitter, and she was subsequently cut after staff cited higher consistency among other players. The family later discovered that the setter position was assigned to a transgender student. Other parents voiced concerns over competitive fairness, urging district leaders to ensure administrative transparency and enforce disciplinary accountability if roster eligibility standards were breached.
In response, Jeffco Public Schools officials noted that under the federal Family Educational Rights and Privacy Act (FERPA) and state privacy regulations, the district cannot comment on the personal records, gender identity, or athletic participation of individual students. The district emphasized that its athletic programs adhere strictly to the bylaws of the Colorado High School Activities Association (CHSAA) and the Colorado Anti-Discrimination Act (CADA), which protect equal access to educational activities and school sports regardless of gender identity or expression. The district added that individual locker room accommodations are made available upon request and denied that school administrators had confirmed any student’s sex or gender identity to parents.
The local dispute coincides with broader federal scrutiny directed at the school district. In March 2026, the U.S. Department of Education’s Office for Civil Rights (OCR) issued findings concluding that Jefferson County’s policies allowing athletic participation and facility access based on gender identity violate Title IX, referring the district to the U.S. Department of Justice after local officials declined a proposed voluntary compliance agreement. In addition, Colorado voters are set to decide on the “Protect Women and Girls Sports Act” ballot initiative on November 3, 2026, which proposes establishing biological sex as the exclusive criterion for participation in female scholastic sports.
Jefferson County Public Schools (Jeffco Public Schools), serving suburban Denver communities, is the second-largest school district in Colorado, administering more than 150 educational institutions with an enrollment exceeding 75,000 students.
